E-Bike Rental Agreement and Liability Waiver

Thank you for renting one of our electric bikes during your stay at Big Bear Lake. These bikes are provided for your enjoyment and convenience through a local ownership group (“Bike Owner”) that maintains and manages the equipment at this property.

Please review the following agreement before using the e-bikes. By signing below, the undersigned acknowledges that they have read, understood, and accept all terms and conditions contained herein.

1. Rental Details

Pickup / Return Location: 219 N. Eagle Drive, Big Bear Lake, CA 92315

Available Bikes: Wolff X-1 E-Bike; Izip Vida E-Bike

Rates: $60 per day for one bike; $100 per day for both bikes

Security Deposit: $250 (refundable after inspection)

After payment and completion of this waiver, the renter will receive:

The assigned bike lock code.
The exact location of the chargers for the rented bike(s).

2. Condition and Responsibility

All bikes are inspected regularly and provided in good working order. By renting, the undersigned agrees to:

Operate the bike safely and in accordance with California law.
Return it in the same condition as received.
Upload clear photos showing the bike(s) and charger(s) after return.
Notify the property manager immediately of any loss, damage, or malfunction.

The renter is financially responsible for any damage, loss, or theft, up to the full replacement value of approximately $2,500 per bike.

3. Helmets and Safety

Helmets must be worn while riding.
If the renter does not have one, helmets are available locally (e.g., Big 5 Sporting Goods ≈ $25).
Ride only on paved roads and bike paths — no off-road or trail use.
Obey all traffic laws and exercise good judgment at all times.

4. Assumption of Risk and Release of Liability

The undersigned acknowledges that operating an electric bicycle involves inherent risks, including but not limited to falls, collisions, and changing terrain or weather conditions. By using the e-bike(s), the undersigned voluntarily assumes all risks and agrees that neither the property owner, property manager, nor the Bike Owner (55Capital Inc.) shall be liable for any injury, death, or property damage arising from use of the e-bike(s), whether caused by negligence or otherwise.

5. Indemnification

The undersigned agrees to indemnify and hold harmless the property owner, property manager, and 55Capital Inc. from any and all claims, losses, liabilities, or expenses (including attorney’s fees) resulting from the use, operation, or possession of the e-bike(s).

6. Rental Terms

Minimum rider age: 18 years
No sharing, sub-renting, or unauthorized riders
Maximum rental period: 7 consecutive days (unless pre-approved)
AirTags are installed for theft-recovery purposes only
Late returns may incur additional daily charges

7. Payment, Deposit, and Damage Fees

Full payment must be received before access codes or charger details are provided.
The security deposit will be refunded after bikes and chargers are verified as returned in good condition.
Return photos must be submitted after return of the bikes.
If damage occurs, a fair market repair or replacement cost will be deducted from the deposit. If the cost exceeds the deposit, the renter agrees to pay the balance upon request.

8. Acknowledgment

The undersigned is at least 18 years old.
They have read and understood this Agreement.
They accept full responsibility for their use of the e-bike(s).
They release the property owner, property manager, and 55Capital Inc. from any and all liability arising from such use.
